NEW DELHI: The Calcutta high court on Wednesday said that it would hear the Central Bureau of Investigation (CBI), the victim's family, and the convict before deciding whether to admit an appeal filed by the West Bengal government, which has challenged the sentence handed down by the trial court in the RG Kar hospital rape-murder case.
The court scheduled the hearing for Monday.
The CBI contested the state's authority to file an appeal, arguing that, as the prosecuting agency, it alone held the right to challenge the sentence on the grounds of its inadequacy.
Mamata Banerjee-led TMC government had on Tuesday moved high court seeking death penalty for convict Sanjay Roy, who was granted life imprisonment in the rape and murder of a medic in RG Kar case.
Advocate General Kishore Dutta moved the division bench in the case.
The court granted permission to proceed with the matter. Speaking at a public meeting in Malda, she stated, "I have been demanding capital punishment for the accused in the RG Kar death case. How can society remain humane if individuals act with such barbarity and cruelty? We passed the Aparajita Bill, but the Centre has yet to act on it."
The sessions court in Kolkata sentenced Roy to life imprisonment. However, despite public outcry, the court declined to impose the death penalty, citing that the case did not fall under the "rarest of rare" category.Get the latest lifestyle updates on Times of India, along with
