KOLKATA: Maniklal Goswami had fractured his 'neck femur' after a fall from his bicycle on November 14, 2000. Three days later he was operated on by a well-known orthopaedic surgeon at a city nursing home. Maniklal required blood during surgery.
His blood group was A+. He was administered B+ blood. A fortnight later, Maniklal was dead. Last week, the state consumer redressal commission held surgeon and former sheriff Sunil Thakur responsible for "negligence" and asked him to pay Rs 5.38 lakh in damages to the victim's widow and son.

In its February 28 order, the commission also asked Avenue Nursing Home to pay Rs 10,000 to the family. On Monday, Dr Sunil Thakur defended himself, claiming he couldn't be blamed either for the blood group mismatch or the death.
"It was the fault of the blood bank, which matched the samples. I performed a surgery on Maniklal Goswami and it was successful. I will move a higher court."
Maniklal's relatives had got the blood from Lion's District 33-B Blood Bank, which in turn rejected the doctor's claims. It said the doctor had not mentioned any blood group in his requisition, and only sent a sample,which was found to be B+.
Maniklal's son, Gorachand, had told the commission that post-surgery, his father was shifted to a bed even when blood transfusion was on. "He was shivering, frothing and breathless.

Dr Thakur asked the attendants to switch off the fan and cover him with a blanket. But things didn't improve. His eyes turned yellow."
At this point, the family suspected something had gone seriously wrong, but were told that the patient had contracted jaundice. Dr Thakur reportedly said there was nothing abnormal about it.
Thereafter, a specialist suspected malignant malaria. A nephrologist suggested dialysis. Maniklal was transferred to Calcutta Medical Research Institute (CMRI), where he died on December 1.
The death certificate, issued by CMRI, mentions post-operative case of fracture of 'neck femur', acute renal failure, jaundice, mismatch of blood and cardiac failure.
