Custody over toddler

Tanisha's mother was found dead. Cases have been filed against her father, grandmother and uncles. She stays with her paternal grandfather and now her maternal grandfather wants her custody.

KOLKATA: The last few months have been extremely traumatic for little Tanisha.
The three-and-a-half-year-old misses her mother, but does not realise that she will never see her again. And if the courts rule against her father, uncle and grandmother, she may not get to meet them either. At least for quite some time.
The toddler is caught in a tug-of-war between her paternal and maternal grandfathers.

She lives with her paternal grandfather Anil Mukherjee in south Kolkata's Pramod Nagar. Her maternal grandfather, Pranab Roy, wants her custody.
On Thursday, following a habeas corpus application by Roy, Calcutta High Court allowed him to meet the child. The division Bench, however, made it clear that the Alipore district and sessions court will have the final say on permanent custody of the child.
In 2001, Pramod Nagar resident Tapas Mukherjee married Mousumi of Chakda, Nadia. Tanisha was born in September, 2003. On April 13, 2007, Mousumi's father was informed by Tapas that his daughter had committed suicide.
The next day, Roy lodged a complaint with police against Mousumi's husband and in-laws, accusing them of torture and abetment to suicide. He also complained that his granddaughter Tanisha was missing. Police arrested Tapas, his mother Mina and brother Tamal. Anil Mukherjee was granted anticipatory bail.

Meanwhile, Roy moved Alipore court, seeking custody of his granddaughter. He also filed a habeas corpus in the high court, praying for Tanisha's production.
On Wednesday, when the matter came up for hearing before the high court, Roy's counsel Sekhar Basu and Debapriya Mitra sought immediate production of the child. The court directed the investigating officer to produce the child and Mukherjee on Thursday. Roy was also directed to be present in court.
On Thursday, Mukherjee brought Tanisha to court. The judges ruled that the child will continue to remain with Mukherjee till the lower court takes a decision.
