KOLKATA: CBI filed its petition in the Calcutta high court on Tuesday appealing to the HC to quash the bail of Bengal transport minister Madan Mitra, who was granted bail by Alipore court on Saturday. Mitra who was undergoing treatment at SSKM hospital, was declared fit for release and Mitra had gone home on Sunday.
But as the CBI filed petition, hours before that Mitra turned ill and was hospitalized as he had breathing problem.

CBI pleaded in its appeal that the Alipore court had given an ex-parte order and it needs to be quashed. It might be mentioned that the CBI investigating officer was absent during the hearing and the case diary was also not presented during the hearing when Mitra got bail.
However, fingers are being pointed at CBI for not presenting the case diary and the absence of I.O, as the court had fixed the date of hearing before hand. But CBI officials denied getting any summon from the court. The CBI pleaded that Mitra can damage the evidences and threaten the witnesses as he is a high profile minister in Mamata Banerjee's cabinet.
However, the defence counsel Asok Mukherjee pleaded that the CBI failed to extract any major evidence from Mitra so his jail custody was meaningless and so the court has rightly granted him bail.
The CBI officials went to the hospital to serve the copy of the petition to Mitra, as he is undergoing treatment.
The case is being heard by Justice Harish Tandon of Calcutta High Court.
