kolkata: the calcutta high court on thursday passed an order setting aside the new appointments of public prosecutor, additional public prosecutor and government pleader of the bankura district court and directed the state government to pay rs 5,000 to the petitioners as cost of the case filed by dilip chowdhury and four other advocates of bankura district and sessions judges court.
the order was followed by the writ petition filed in february this year challenging the legality and validity of the termination of the petitioners' appointment as pp, app and gp of bankura court and appointment of new persons in the said posts, on the ground that there was no consultation with district and sessions judge either by the dm, bankura or by the lr department before making such appointments. during hearing it was contended that no fair procedure was followed by the state government specially by the lr department before making such appointments. in the judgement justice barin ghosh held that appointments were made in violation of provision of section 24 crpc and also relevant provisions of lr mannual. the court, however, disapproved the action of the dm and directed to recover the cost of the case from the erring officers of the dm office.
