KANPUR: Neglecting the court warning proved dear for sub-inspector Hari Singh when an annoyed presiding officer of Additional district and sessions court II of Kanpur Dehat, on Friday, not only took him in judicial custody but also sent him to lock up.
The presiding officer, C M Dixit recalled his order when the SI tendered an apology and submitted that due to old age his memory was short and he was on the verge of retirement.
In future, he would never repeat such an act.
The incident took place on Friday morning when SI Hari Singh presently posted at Sikandara police station appeared for his evidence in a case of rape styled as State vs Awadhesh Kumar of Rasoolabad police station. Hari Singh was investigation officer of that case and he had recorded statements of all the witnesses in case diary under Section 161 of CrPC.
He mentioned the name of complainant, Arvind Kumar, who was father of victim, in the statement of victim and stated that Arvind Kumar had exploited her physically. The accused, Awadhesh Kumar on this very ground had got bail in the beginning that he was not named by the victim. On the other hand, the SI was suspended for his faulty investigation in this case, the additional district government counsel informed.
The court today pointed out to him several times about what he was adducing but the SI overlooked all those indications and was adamant that the name mentioned in the statement was Awadhesh Kumar and not Arvind Kumar. The annoyed judge himself read out the name and questioned Hari Singh again but the latter was adamant that the name he wrote in the statement was Awadhesh Kumar and not Arvind Kumar. The judge, thereafter, asked the court pairokar to take him under judicial custody and remove his belt, badges and revolver and then send him to lock up.
After about three hours the SI sent his written submission that he was on the verge of retirement and due to old age he could not understand the directions and questions asked by the court. The name recorded was Arvind Kumar and not Awadhesh Kumar, as previously insisted by him. It was a mistake and human error. He would not repeat such acts in future and give due respect to the court.
