KANPUR: Metropolitan magistrate X of Kanpur Nagar issued a show-cause notice against superintendent of police, Kochi (Kerala), on Thursday, asking him to explain why he should not be punished for wilful non-compliance of a court order. The officer has to submit his reply by August 31, failing which suitable action will be taken against him.
The presiding officer said that the court had issued a non-bailable warrant and proclamation for absconding under section 82 of CrPC against the accused M/s Lee Marse Marketing Pvt Ltd and its directors, in a case under the Negotiable Instruments Act -- styled as Khandelwal War Company v/s Lee Marse Company and Others -- and had directed the SP to submit his report on or before July 23.
Both the documents had been received by the SP's office but, till Thursday, the court did not receive any compliance report of its orders. It appears that the SP was deliberately not complying with the court order and hence his act amounts to contempt of court.
According to case file, the complainant firm was producing readymade garments and the defendant parties used to purchase its products. The company, against a supply, had issued a post-dated cheque of Rs 1,29,160 of
ICICI Bank and instructed to present it before the bank on July 20, 2009. On due date, the complainant presented the cheque but same could not be honoured by the bank. The bank memo depicted that payment could not be made as there was not sufficient amount in the account.
Register FIR: Allowing a complaint filed by Jitendra Kumar Bajpai against Umesh Bajpai, the additional chief metropolitan magistrate VIII asked the Kidwai Nagar police station to register a case under appropriate sections of IPC and investigate into the matter.
The complainant had alleged that Umesh Bajpai along with half-a-dozen armed persons had forced his way into his office and they looted a sum of Rs 75,600 after ransacking the office.
