Kanpur: Special judge Pocso Act court Rajveer Singh on Tuesday rejected the criminal appeal of accused

According to ADGC Sushil Kumar Verma, the station officer Panki police station and other cops at around 4.15 pm on May 27, 2020, had taken accused

and Saurabh Singh to the spot to recover the arm used in the murder.
The accused guided the police party to the spot near Panki canal Mirzapur Khanpur Colony from where they lifted a blood-stained brick from a bush which had been used in the murder and handed over the same to sub-inspector Dhan Singh.
In the meantime, Mohan Verma snatched the pistol from the holster of SI Dhan Singh and loaded it. Aiming the gun towards the police party, he said that the way he had killed Daroga he would kill all of them. Later, he opened fire at SI Amit Kumar Tiwari who luckily escaped. The police also opened fire and injured Mohan Verma.
Saurabh took the gun from Mohan Verma's hand and opened fire at the police party. He too suffered an injury in his leg when police opened fire in self-defence. Both were arrested and a case was registered against them under section 7/27 of the Arms Act at the Juvenile Justice Board.
The board sought a report from the probation officer about them.
The ADGC stated that the probation officer stated in his report that if the accused were released on bail, they might enter the crime world again, and there were all possibilities that they would threaten the witnesses, therefore, they should not be released on bail.
The court in its order observed that as the Juvenile Justice Board had passed the legally correct order on the basis of incident, the act of the accused and the report of the probation officer, hence there was no need to alter its order.
The court ratified the board's order and rejected the criminal appeal of accused Saurabh Singh.
