KANPUR: Additional sessions judge FTC (offence against women) Kanpur Nagar, Harendra Kumar Ojha, on Thursday convicted one Nathu Singh Chandel, a resident of village Sayar under Binwar police station in Hamirpur district, for committing murder and sentenced him for life imprisonment along with a fine of Rs 25,000.
According to Omendra Dixit, additional district government counsel, the case is of Hamirpur and there were three accused. The other two accused were Jagannath Soni alias Chotey and Baijnath Soni, both residents of village Sayar in Hamirpur. During the trial, both died hence the case against them was abated.
The incident had taken place on February 8, 1989. The victim and accused both were residents of the same village. Accused Baijnath and Jagannath were interested to take illegal possession over a land near bus stand and had raised a platform on that land.
The land belonged to one Jay Singh. Jay Singh along with his friends had demolished the platform at around 4 p.m. Around 7 p.m. Jai Singh who was sitting near a bonfire expressed to meet the call of nature and he went outside. After a few minutes a gunfire took place and Jai Singh shouted that he had been shot.
Injured Jai Singh said that one Lallu Singh was also injured and he was lying in a pool of blood in front of the Bhagwati’s house. Lallu Singh died on the spot. Injured Jai Singh informed that Baijnath Soni and Jagannath Soni and Nathu Singh had shot him and Lallu Singh.
Ajay Kant Kannaujia, ADGC, who too had pleaded this case on behalf of prosecution stated that injured Jai Singh had given dying declaration to SDM after that he had succumbed to his injuries.
The case was committed to session court Hamirpur on October 29,1994 and on the orders of Allahabad high court the case was transferred to Kanpur Nagar on September24, 2007. The prosecution presented as many as 16 witnesses in this case.
One of the witness had adduced in his evidence that there was an old enmity between deceased family and Nathu Singh. Nathu Singh had supported accused Baijnath Soni and Jagannath Soni to settle scores with Jai Singh and others.
