Doctor's bail plea rejected in sex determination case

KANPUR: District and sessions judge Ranjana Pandya on Friday rejected the bail application of Dr Sandeep Mishra, who was arrested by the Kakadeo police on charges of conducting sex determination test and abortion of female foetus.
The judge observed that sex determination and abortion was being committed by the intellectual class, who enjoy high position in the society.

"The killing of female foetus after sex determination is a social crime and I cannot hesitate to say that it would have far-reaching effect.Female foetus killing will definitely result in decreasing the sex ratio which will ultimately lead to increase in crime against women," the judge observed.
The judge further stated in her order that it was a bitter fact that due to such acts, the ratio of the girl in comparison to boys was much less. The crime was against the professional ethics of medical science and was a social crime against the whole society.Opposing the bail application of Dr Sandeep Mishra, government counsels Santosh Yadav and Abhimanyu Sachan stated that complainant Sanjay Singh was a social activist and he had conducted a sting operation to check this evil practice on February 23, 2013. He had contacted a woman doctor of Surabhi Hospital for sex determination of an embryo and abortion if there was a girl child. A deal had taken place between them over a payment of Rs 5,000.
The doctor asked him to go to ultra sound center situated in front of Anurag Hospital and get aborted the female foetus with the help of doctors. There was sufficient evidence against them. Therefore, bail of Dr Sandeep Mishra be cancelled.The judge observed that accused was not named in the FIR but it did not mean that investigation officer could not investigate and find out the names of actual culprits. There was sufficient evidencd against the accused and enough to connect the doctor with alleged crime. TNN
. Hence, it was not a fit case for bail and the bail plea of Dr Sandeep Mishra was being rejected, accordingly.
