Court rejects bail application of criminal conspiracy accused

Kanpur: Additional sessions judge Kanpur Nagar Pramod Kumar IV on Saturday dismissed the anticipatory bail application of Sarvesh Singh who has been charged by the Kidwai Nagar police for cheating, fabrication of papers, misappropriation of funds and criminal conspiracy (sections 420/467/468/406/504/506 IPC).
The court in its order observed that the accused in collusion with the co-accused had cheated the complainant and others and collected Rs 15,00,000. He had also issued letters for physical test, police verification and appointment letters which were on record. When they were cross- checked at Railway Recruitment Cell Gorakhpur they were found to be fake. As the charges levelled against the accused were of serious nature and investigation was going on, therefore, there were not sufficient grounds for anticipatory bail hence the bail application was liable to be dismissed, the court said.
According to ADGC Bhaskar Mishra, complainant Raj Narayan in his FIR lodged at the Kidwai Nagar police station stated that one of his friends named Ashish Kanaujia’s father Rajendra Prasad Kanaujia is upper level driver in te Railways .Ashish introduced his father to him and his other friends and stated that he would provide employment in Railways but for that they had to spend Rs 6 lakh.
Believing him, he and Chetan Kushwaha, Govind Kumar, Saurabh Singh Javed Akhtar, Ajay Singh Bhadauria, Akhilesh Kumar and Alok Pal on March 13, 2017 reached Ashish's house around 6.30 pm. Rajendra Singh introduced to them one Sarvesh Singh and his wife Romi Singh and assured that Sarvesh would manage the job after all of them pay him the remaining money.
All of them handed over Rs one lakhs each and testimonials to Sarvesh Singh who then gave them forms and asked them to fill them giving all the required details. After a few days, he and others received letters from NE Railway Gorakhpur and Eastern Railway Howrah. At Gorakhpur, Sarvesh introduced Vinay and Ankit Tyagi who got their medical examination done at the Gorakhpur Railway hospital, arranged 40 days training and collected Rs 12 lakh from each of them. Akhilesh and Alok Pal were sent to Howrah where they met Yogendra Singh Yadav who got their medical examination done.
They thereafter said that joining of service would take place in a few days and pay the remaining sum. Thus they had collected Rs 12 lakhs from each of us.After some time they were asked to join at Howrah and Gorakhpur .When he and others reached there they asked to stay here later asked to go back as there was some technical problem.
When he and the others later asked them when to join their duties, Sarvesh Singh vacated his house and shifted to Ghatampur. When he and others reached there Ashish and his father abused and warned them not to contact them. They warned him of dire consequences if the matter was reported to the police.
Accused Sarvesh Singh in his anticipatory bail application stated that he was innocent and implicated by the complainants and the police might arrest him.
