Court: Evidence points to Shivam Mishra as accused
Kanpur: Hearing the much-publicised Lamborghini car crash case, additional chief judicial magistrate (VII), Kanpur Nagar, Amit Singh, on Wednesday dismissed the surrender application of Shivam Mishra's driver, saying the tobacco baron's son is the accused as per the police investigation report. The ACJM (VII) said that since the name of Shivam's driver, Mohan Lal, isn't mentioned anywhere in the FIR, his application would not be accepted, and the car would remain at the police station.
"The applicant was neither named in FIR, nor his name cropped up in the police investigation. Therefore, his application has no merit and is liable to be dismissed," he said. Two petitions were filed in the court of ACJM (VII) on Tuesday, with the driver applying for judicial custody and the car owner seeking the release of the Rs 10 crore car.The prosecution, led by district govt counsel (criminal) Dilip Awasthi and public prosecutor Nagendra Kumar Mishra, opposed the driver's bail application, stating Mohan Lal wasn't named in the FIR and wasn't found to be the accused during the investigation. The court also denied the request to release the accident-involved car, citing the police report. Public prosecutor Mishra stated that the police had registered an FIR alleging the car caused injuries and that evidence suggested Shivam was driving. The public prosecutor also urged the court to direct Shivam to cooperate with the investigation and provide relevant documents, as he's not cooperating with the technical examination of the high-end car. While holding the vehicle release application, the court directed Shivam to cooperate fully with the investigation and provide all necessary documents to the police to facilitate the technical examination of the car in accordance with the law. The court observed that the application would be considered only after the technical examination report was submitted. The ACJM also directed the police to complete the technical examination of the vehicle and submit the report before the court on Friday.Earlier, Shivam's lawyer Narendra Kumar Yadav stated that the injured party, Mohd Tausif, has settled with the driver and identified Mohan as the one driving the vehicle. He said Tausif has also stated that he doesn't want to pursue the case further. The Lamborghini, allegedly being driven at a high speed, triggered chaos on a busy stretch in Kanpur after it rammed into a parked motorcycle and an autorickshaw at Gwal Toli police station area on Sunday afternoon, leaving at least six people injured and several vehicles damaged. The Lamborghini, bearing a Delhi registration, was moving at an excessive speed when it first collided with an autorickshaw. After the initial impact, the car reportedly accelerated further, lost control near a turn and went on to hit a parked motorcycle owned by Arya Nagar resident Vishal Tripathi, who was standing nearby and talking to someone. In the ensuing chaos, three people, including Chaman Ganj Ghosiyana resident Taufiq, sustained injuries while trying to escape the speeding vehicle. They said the car mounted the motorcycle's front wheel and dragged it for some distance before hitting an electric pole and coming to a halt.New CCTV footage emerged on Tuesday, showing Shivam's bouncers exiting a black SUV and running towards the Lamborghini to extract the driver from the car. Shivam was seen driving the Rs 10 crore Lamborghini Revuelto, according to several videos from the incident site and eyewitnesses. Countering the claim of Shivam's lawyer, Police Commissioner Raghubir Lal said the FIR initially did not mention the driver's name because the identity of the person driving the vehicle was not clear. He said evidence gathered so far, including CCTV footage and eyewitness statements, confirmed Shivam was driving the high-end car.

This is FACTS from Jolly LLB, it's just repeating in 2026"Young and innocent Rahul deewan. Young and innocent. Jisne paanch logon ki jaan le li. Aur Rajpal sahab keh rahe hain – “Is it a joke?” Nahi janab, joke kya hai? Main batata hoon aapko. Pichhle aath mahino mein Rajpal sahab ne Land Cruiser ko truck bana diya hai. Chhe mahina aur ye case chalega aur wo ye saabit kar denge ki wo truck nahi balki train thi. Saal bhar aur ye case chalne dijiye. Aur main daave ke saath kehta hoon ki Rajpal sahab ye saabit kar denge ki ye aadmi Salakant Mishra nahi balki Shahrukh Khan hai. Aur lack of evidence ke bina pe aapko ye baat maanni hi padegi. That is a joke janab, ye joke."Read allPost comment
