Bail plea of ex-MLA IrfanSolanki’s aide dismissed
Kanpur: Ajay Kumar Tripathi in charge session judge/additional session judge court no. one dismissed on Monday bail application of Shabbar Hussain, an associate of jailed ex-MLA Irfan Solanki, charged with house trespass and thrashing on complaint of Mohd Nasim Arif.Nasim Arif had stated in his FIR that he owned a plot of 500 sq meters. On March 16, 2018, then MLA Irfan Solanki, his brother Rizwan Solanki uncle Ishtiyaq Solanki, Asif Dalal, Shabbar Hussain, Abdul Moid, Shakeel Baig and 15 other persons had taken illegal possession of 200 sq meters of the plot. Arif said when he visited the site along with Shariq Ali Barkati, MLA Irfan Solanki told him to “forget about the plot”. When he opposed it, Solanki’s aides thrashed Arif while Rizwan Solanki put the barrel of his pistol in his mouth, he complained. Scared by the incident, Arif did not lodge FIR against them but later moved applications before the administration and state government to lodge the complaint.The presiding judge observed that attached sale deed clearly showed complainant Mohd Nasim Arif had purchased part of land and revenue inspector had submitted in his report that Arif’s name had been on record as joint account holder along with Kalawati. The accused was named in the FIR and the complainant and witness told police about the active role of Shabbar Husain, whose offence was of serious nature, hence his bail application was liable to be rejected.According to Ravindra Awasthi, additional district government counsel, the defence counsel had pleaded there was no date of incident in the FIR. Hearing adjourned: Hearing on bail application of Samajwadi Party MLA Irfan Solanki in a fake Aadhaar card case was postponed by session judge Ajay Kumar Tripathi on adjournment application of accused. The presiding judge fixed May 1, as next date for hearing on the bail application.According to Ravindra Awasthi, ADGC in this case, the MLA had issued certificate to Dr Rizwan Ahmad, a Bangladeshi citizen, saying he was an Indian and had helped him obtain an Aadhaar card on forged documents. Police had arrested MLA Irfan Solani in this case on December 11, 2022. He said the hearing on bail application of Rizwan Ahmad was also fixed for Monday but in defence sought adjournment in that matter too. The presiding judge fixed May 5, as next date for disposal of the bail application of Bangladeshi citizen Rizwan Ahmad.
