KANPUR: The additional district and sessions court number 14 of Kanpur Nagar on Friday summoned two student leaders as co-accused in a murder case. The student leaders were named as Bunty Sengar and Arvind Tripathi alias Chotu. Both were president and general secretary, respectively, of DAV Degree College when the murder had been committed.
The presiding judge, Krishna Kumar (fourth) summoned the two student leaders in the case styled as State vs Ashish Sahu when material witness of the case named them in his evidence and stated that both were named in the FIR but the investigation officer had deleted their name.
According to case file, accused, Ashish Sahu and two others, Bunty Sengar and Arvind Tripathi had shot Gurpreet alias Sunny near Krishnanagar telephone exchange on September 14, 2008 about 8.15pm. Bunty Sengar and Arvind had caught Gurpreet from back and had incited Ashish Sahu to shoot him dead. Ashish, thereafter, shot him from his pistol.
Gurpreet's father was eye-witness of this murder and during his evidence he adduced before the court detailed narration in his examination-in-chief. He also stated that the investigation officer had not recorded the statements of those who were eye-witnesses and with an intention to help the accused he fabricated evidence and rejected several appropriate material which could be helpful in deciding the case.
The additional district and government counsel, Koushal Kishore Sharma apprised the court that the investigation officer had deleted the names of Arvind Tripathi and Bunty Sengar during his investigation and had made only Ashish Sahu the accused.
The government counsel, thereafter, moved an application under Section 319 of CrPC and submitted that the two co-accused should be called in the court and prosecuted as the evidence against them was enough. The presiding officer issued summons to the two co-accused.
