JODHPUR: The Rajasthan High Court on Wednesday issued notices to the state government and the registrar general of the high court as well as the registrar (Examination) while allowing a petition challenging the constitutionality of the rule related to minimum age in RJS-2017 examination.

has sought the reply by January 4 while allowing the petition by one Sarwar
Khan
.
Arguing in the court, petitioner's counsel Rajak Haidar said, minimum age for the civil judge is 23 years under rule 17 of
Rajasthan Judicial Service
Rules 2010.
"On the contrary, the minimum age for a civil judge in the states of Delhi, Haryana, MP,
Gujrat
and Chhatisgarh etc. is 21 years. Also the minimum age for the civil services examination under UPSC and
RPSC
is also 21 years," he argued adding that in such condition, the minimum age of 23 years for civil judge as 23 years in Rajasthan is unjustifiable.
Referring to the ground of the petition, the counsel said that the apex court has said that youths should be given opportunity in the judicial services and in view of this, depriving a youth with qualification in law from appearance in the examination on the basis of the age is unconstitutional, unlawful and inappropriate.
After the preliminary arguments, the court issued notices to the state government, Registrar General (HC) and Registrar (Examination) seeking reply bu January 4. The petitioner had completed the law graduation from the
Jai Narayan Vyas University
in 2015 and eligible for the direct recruitment as civil judge. But given the fact that the minimum age was required to be 23 years on January 1, 2018, he was not eligible for the examination on account of the age below 23 years.
