HC groups trial of 259 cases against Sanjivani CMD

Jodhpur: Rajasthan High Court’s Jodhpur bench on Tuesday issued an order to streamline the trial for the 259 cases registered against Sanjivani Credit Cooperative Society’s CMD, Vikram Singh Indroi, across the state. Justice Farzand Ali, while hearing Indroi’s petition for a clubbed trial of the cases, stated that cases triable before a judicial magistrate should be transferred to a larger district by grouping nearby districts. Cases registered under Banning of Unregulated Deposit Schemes (BUDS) Act against Indroi should be transferred to the district & sessions court in Jodhpur, the judge said. Investigating agencies were directed to file chargesheets accordingly in cases where charges are yet to be filed.The court emphasised the need for a joint trial, noting that if conducted separately, the trials in all the cases would take an estimated 50 years to complete. Considering that Indroi was 45 years old and had already been in jail for five years, the court stated that a constitutional court cannot allow an accused to remain imprisoned until death. The court also highlighted the practical challenges of shifting the accused from one police station or prison to another for each FIR.According to Indroi’s counsel, of the 259 cases registered against him, 63 will now be tried at CJM courts, while 196 cases registered under BUDS Act will be tried at the district & sessions court, Jodhpur.
