Top court dismisses petition to transfer Sanjivani case to CBI

Jaipur: A Supreme Court bench comprising Justice A S Bopanna and Hima Kohli on Monday dismissed a writ petition filed by one Sanjivani Society Peedith Samiti seeking transfer of investigation into the alleged scam by Sanjeevani Multi State Credit Co-operative Society from the Rajasthan police’s special operations group (SOG) to the Central Bureau of Investigation (CBI).
Counsel for the State of Rajasthan, senior advocate Siddharth Lutra, opposed the petition saying it was filed by an unregistered society. Sanjivani Peedith Sangh, a registered association of more than 5,000 depositors, represented by lawyers-on-record Aditya Jain and Mitul Jain also opposed the petition, saying it had been filed at the behest of some of the accused persons to bypass the investigation being conducted by the SOG.
They also informed the court that the CBI, in an earlier petition before the high court, had opposed the transfer of investigation.
Dismissing the petition, the Supreme Court held that such petitions were not maintainable and it would be inappropriate to intervene.
