JAIPUR: Rajasthan High Court on Wednesday ordered that the employees of Rajasthan University (RU) will be eligible for pension from the date of their absorption (the date on which they joined the university) in the university and not from the date of regularization.
The single bench of Justice Manish Bhandari order followed a petition by Ashok Kumar Yadav and others.
The university refused to pay them pension from the date of absorption on the ground of financial crisis.
The court said the university could not deny the benefit of pension to the retired as the fund deducted under the contributory pension scheme could not be utilized for any other purposes other than pension.
The court said when the career advancement scheme was introduced in August 5 2008 the petitioners earlier service period (temporary) was also considered.
The court said the petitioners are entitled to retirement benefits by counting their length of service from the date of their absorption given in the order dated on August 5 2008(when the career advancement scheme was introduced) and directed the university to give the pension benefits within four months.
The court asked the government to allot sufficient fund to meet the financial burden of the university.
