Raj HC stays order in B2 Bypass land dispute

Jaipur: The Rajasthan High Court Tuesday stayed an April 9 order of a single judge in the ongoing 42-bigha land dispute on B2 Bypass, granting interim relief to residents.

A division bench comprising Acting Chief Justice Sanjeev Prakash Sharma and Justice Shubha Mehta passed the stay while hearing an appeal filed by Shriram Colony-B Vikas Samiti. The court also issued notices to the state govt, Jaipur Development Authority (JDA) and other concerned parties, seeking their responses.

The single judge, in the April 9 order, had declared Rajasthan Housing Board, the owner of the disputed land and held the July 31, 1981 agreement to sell as illegal and void. The order had also invalidated the layout approval granted by the JDA on May 29, 1995, along with subsequent actions, observing that ownership cannot be transferred merely on the basis of an agreement to sell.

Challenging the order, the petitioners argued that the single judge had re-adjudicated issues already settled by the Supreme Court. They contended that allegations of fraud raised by the Housing Board had been dismissed in earlier judicial proceedings.

The appellants further submitted that nullifying the 1981 agreements would cause grave injustice to nearly 200 families residing on the land for around four decades. They urged the court to set aside the order.

After hearing the arguments, the division bench observed that the matter required consideration and stayed the operation of the impugned order until further proceedings.

The case pertains to a long-standing dispute over ownership and legality of land transactions on the B2 Bypass, with multiple stakeholders involved.
