The counsel for the petitioner Rajendra Soni and Mohit Soni said the reason for the petitioner’s disqualification is that she had abandoned a master’s degree course midway at IIS University. They pointed out that clause 20-C does not apply to students who have been admitted to Rajasthan University in the academic year 2016-17 but attracts only in a situation where a student admitted in the university in the preceding year has failed to clear all the papers in the course to which individually or in the aggregate.
The court agreed with the contention of the petitioner that she was admitted only in the current academic year. Under no circumstance the clause 20- C of the constitution attracts her disqualification from contesting RUSU election. Besides having admitted to IIS University, Jaipur in 2015 -16 , the petitioner had cleared all papers in semester I and II before choosing to change from the said university to Rajasthan University.
