JODHPUR: The trial of Jon Carlo Patton, who was charged with the murder of his mother Cynthia Iannarelli in a resort at Osian near Jodhpur on the night of August 12 and 13, will start on Friday after one-and-a-half months of his detention in the juvenile home. The delay in beginning of the trial is attributed to the delay by the police in filing the chargesheet against Patton, which was finally filed in the board on September 24.
The chargesheet, running into 200 pages, says Patton slit the throat of his mother with a sharp knife in the hut where they were staying and dumping her body below the sand dune, on which their hut stood.
Counsel for the defence Manish Vyas said police have slapped Sections 302 and 201 of the IPC against Patton in her chargesheet, which pertain to murder and destruction of evidences respectively. He claimed that Patton has been falsely implicated. The board has taken the cognizance of the chargesheet and now the trial will begin.
According to Section 33 of the Juvenile Justice Act, the trial should be completed in four months from the date of detention but the dilly-dallying of the police in filing the chargesheet restricted the legal process to begin, said Vyas. Though the police had filed the chargesheet in the court on Sept 17, the presiding officer had returned it on the ground of various shortcomings in it. The board has now taken the cognizance in the case under Section 190 of the CrPC and will read out the charges against Patton on October 1.
