INDORE
:Madhya Pradesh high court
has directedMP Warehousing and Logistics Corporation
to raise retirement age of its employees to 62 years, in consonance with the state government’s policies. The directive was passed in a petition moved by an employee who was relieved by the corporation at the age of 60 years on the grounds that a resolution of board of directors was needed for extending age of retirement.
Madhya Pradesh
Warehousing Corporation Staff Regulations, it was stated that all state government policies as in force from time to time in respect of age of retirement shall be applicable to corporation's employees.Amiruddin Akolawala
was working at the corporation as a sub engineer (executive) and was given a notice on June 21, 2018, regarding his retirement on July 31, 2018, when he turned 60. He was eventually retired and relieved on the day he turned 60.Justice Rohit Arya ruled that petitioner was entitled for all service benefits including monetary benefits accrued to him on the post of sub engineer (executive) treating him in continuous service up to 62 years of age.
“Our main contention before high court was that when in 1979 the Corporation has passed resolution to adopt the policy of the state government and it is not amended, the recent enhancement in the age of superannuation would be applicable to the petitioner. The order of retirement as illegal,” advocate Murtuza Bohra, counsel for the petitioner said.
