MP: Consumer forum orders hospital to pay Rs 8 lakh compensation for medical negligence
INDORE: Consumer forum has ordered a private hospital and its director to pay Rs 8.23 lakh as compensation for medical negligence to complainant including Rs 5 lakh for mental and physical harassment.
The forum comprising chairman Omprakash Sharma and member Sumitra Hathiwala passed the order on complaint of Krishna Roy against the hospital and an insurance company.
Complainant’s counsel Surendra Gupta informed court that Krishna Roy had been a patient of diabetes for last 12 years.

She got admitted to hospital on February 14, 2011 after complaint of shoulder pain and insomnia.
The doctor diagnosed him with type-2 diabetes and spondylitis. She remained admitted for three days and underwent electrocardiography. She was discharged on February 15, 2011, said Gupta.
The complainant again went to hospital and was admitted with similar complaints along with vomiting, dizziness on April 4, two months after she was discharged. Doctors had tested her for CE CET, RBS Audiograph and ECG. She was discharged on April7, 2011, said Gupta.
She was again admitted in May and underwent different tests. Doctors advised her for metabolism surgery for reducing fat in the body. She underwent surgery and remained admitted to for a week and was discharged on May 21, 2011. But, problems continued, said Gupta.

She was again admitted to hospital in June and August. But, her condition didn’t improve. Later, she went to a private hospital in Chennai for treatment. The doctors their informed her that the hospital performed bariatric surgery for reducing weight. She was reduced to 35kg from 60kg, said Gupta.
She went with papers about wrong treatment given to her to hospital. But, they denied giving any compensation to her. So she moved to forum against them for compensation of Rs20 lakh for medical negligence, said Gupta.
Hospital counsel Gaurav Chahbra informed court that the complainant failed to follow precautions advised by doctor after surgery. This was reason that she had problem with vomiting and dizziness. The forum however, accepted the complaint and ordered for compensation.
