Tukoganj police station in charge Manoj Ratnakar said, "We have recorded statements of two key witnesses of MPCA chairman M K Bhargava and secretary Narendra Menon. The victim would record her statement under Section 164 of CrPC before a local court on December 5 as she was medically unwell on Monday."
Shah's counsel Ajay Bagadiya confirmed judge has given instruction for hearing in the court regarding stay on arrest petition filed by the MPCA ex-joint secretary Shah. Shah has moved Indore bench of Madhya Pradesh high court (MPHC) on Monday terming allegations against him as baseless and devoid of facts.
Defence counsel Ajay Bagadiya appeared before the court on Tuesday. He said Justice N K Modi while hearing the petition scheduled next hearing on Wednesday. Also, defence counsel argued over the delay in lodging FIR by the girl. "The incident as per the girl had happened on September 23 and the complaint was lodged on November 28, therefore the explanation for delay was not put up properly." The defence lawyer added the victim instead of going to the police with the complaint went to the Press, which certainly raised questions over the intentions.
"The allegations are baseless against Shah and the petition sought stay on the arrest of Shah during its pendency," Bagadiya said.
