The police had registered FIR against Prabhakar, the director of the company, Divy Nautiyal and Narendra Singh Bisht, Indore branch manager of one of the six companies.
The case was filed on the complaint of two former employees of the company alleging they were yet to get any returns on the money they had deposited with the Indore branch of one of Apace companies. The Indore branch was opened in December 1997 and was shut down in July 1999.
Police, in its FIR, had mentioned that they had found a photo album and a banner mentioning Prabhakar as one of the directors of the company. Prabhakar’s counsel, Harinarayan Giri, claimed they have documents to prove that Manoj Prabhakar’s name did not exist in any of the six Apace companies -- Apace Savings and Mutual Benefits Ltd, Apace Indian Corporation Ltd, Apace Housings and Constructions Ltd, Apace Plantations and Resorts Ltd, Apace Indian Marketing Ltd and Apace Nidhi and Finance Ltd.
In August 2001, Prabhakar had secured anticipatory bail in the case from Indore branch of Madhya Pradesh high court.
