Madhya Pradesh court convicts 39 of attack on police party during curfew in 2014

INDORE: A sessions court in Khandwa district has convicted 39 persons for seven years of rigorous imprisonment and fine of Rs 6500 each in an eight-year-old case for attacking a police team during a curfew.


The court of 3rd Additional Sessions Judge (ADJ) Prachi Patel convicted 39 persons for attacking police teams, injuring at least 15 personnel during a curfew on intervening night of July 30 and 31 in 2014.

The curfew was imposed in district as the situation became tense after murder of Imlipura resident Sushil Kumar, who ran a pathology in district on July 30 in 2014. The then district collector-imposed section 144 to prevent the situation from escalating.

During curfew a police team was on duty in Ghaspura Kshetra Mohalla area of district, when a group of residents came out of their house together around midnight, prosecution story stated.

The police team asked them to go back to their homes, but the crowd resented, threatening the police force to kill them, and even hurling abuse at them, the prosecution story stated.

The police informed the control room and police deployment increased. Till the deployment of police party, the residents armed with stones, cane, axe, stick, cane out and attacked on police personnel, prosecution story stated.

Around 15 police staff including then Kotwali police station incharge Anil Sharma sustained injuries and police vans were vandalised. The police cornered the crowd to arrest 46 accused including 4 minors and recovered stones, cane, axe, stick, canes from them, prosecution story stated.

Additional Government Prosecution Abhay Dubey said, “The trial in session court took place against 42 persons arrested from spot. Of those two were acquitted and one died during trial. The remaining 39 are convicted for a maximum of seven years and a fine of Rs 6500.”

“In the trial, 33 witnesses’ statement were recorded, evidences were examined and identification was done to convict those 39 persons under sections 307, 188, 147, 148, 149, 353, 294, 323, 506, 427, 332, 171, IPC for attempt to murder, rioting, voluntarily causing hurt, hurling abuses, and others and section 3 of Prevention of Damage to Public Property Act, 1984”, added AGP Dubey.
