INDORE: In Dilip Patidar missing case, the Indore bench of MP High Court on Thursday directed the CBI to complete investigation on all aspects related to the case.
The Maharashtra ATS had taken Patidar to Mumbai in connection with the 2008 Malegaon blast probe and since then he is missing.
Taking tough stand on the CBI's status report on Patidar, the bench of Justices S S Kemkar and Prakash Shrivastava asked officials what action they had taken against ATS officials.
The court was also upset at why despite knowing that all developments were on paper, the FIR was lodged against unknown persons.
The court observed that it was clear on ATS records as to which police team had taken Patidar, who quizzed him and under whose supervision he was released. Despite knowing that those connected to the case were in and around Mumbai, why was CBI wasting time coming to Indore and repeatedly quizzing same people.
Presenting its report, the CBI said the investigation was still on and it was expecting reports on missing persons from some more places.
Taking cognizance of the report, the court assured the investigating agency of all possible help from states concerned which would make the reports available soon. The court also observed that there was nothing new in the status report, and said in the last one-and-a-half years, the CBI submitted three status reports and none of them has anything new. Making a strong remark, the court asked who was not helping the CBI in the investigation. "Neither you tell, nor are you able to trace the person," observed the court, adding that why the CBI was not taking action.
When the court wanted to know on registering the FIR against unidentified persons regarding Patidar's missing instead of 'by name' FIRs, the investigating agency said the investigation was limited to Patidar's missing. Then the court directed that the investigation should be on all aspects of the case, and the court had given the CBI an ultimatum and on January 12, the court has directed the CBI to present its ATR, which was specific and clear about the case. The court also directed the CBI to specifically mention the action taken against the officials of Mumbai responsible for Patidar's missing.
Additional Advocate General Manoj Dwivedi represented the state while the Assistant Solicitor General Vivek Saran appeared on behalf of the Centre. On behalf of Patidar, advocate Romesh Dave pleaded.
