T HC hands over boy to his mother

Hyderabad: A division bench of the Telangana High Court on Monday ensured that a five year old boy, who was suffering on account of his parent’s marital dispute, was united with his mother.
The bench of acting chief justice Raghavendra Singh Chauhan and justice A Rajasheker Reddy went to the extent of ordering the intervention of the Karnataka DGP when the Bengaluru police did not obey its orders to produce the boy before the court along with his Bengaluru-based father.
The father took away the child forcibly from her Huda colony residence at Chanda Nagar in Hyderabad. When the mother, Shailaja, filed a habeas corpus plea, the bench directed that the father produce the boy before the court. The father did not obey the order. The bench then directed the Benguluru DCP to produce both the father and son before the court. When that too did not happen, the court directed the DGP of Karnataka to appear before it and explain the failure.
On Monday, Benguluru DCP Anna Malai appeared before the court and produced the father and the son.
Since the DGP was busy with Karnataka Lok Sabha elections, he could not come, said Karnataka state counsel Giri Kumar, who represented the police. C Yadagiri, the mother’s counsel, told the court that to a child, the mother is the natural guardian. The bench heard the matter in camera and directed the police and the father to hand over the child to the mother.
