hyderabad:justice b sudhershan reddy of the ap high court on wednesday declared that the government is bound to meticulously scrutinise applications seeking recognition of engineering institutions for minorities in the state. the judge cautioned against those masquerading as minorities, while dealing with a batch of writ petitions filed by the management of various engineering colleges seeking minority status and complaining of inaction by the government in considering their applications.
the judge declared that the government must pierce through the 'minority veil' to discover the truth and genuineness of the claims. grant of minority status to the institutions set up by pretenders masquerading as minorities is fraught with serious consequences and such a course would be detrimental to the interests of the genuine minorities, the judge observed. the space made available for establishing educational institutions of choice is to the religious and linguistic minorities. such space cannot be permitted to be usurped by others masquerading as minorities, the judge added. the action of the government also came in for criticism.the judge dealt with certain instructions issued by the government in the case of considering applications of minorities and also the formulation of a scheme. the judge called it a reflection of the unrequired anxiety on the part of the state government. finding fault with the method of ad hocism in the decisions, the judge said,we have a system governed by the rule of law and constitutionalism in which every act of the government, at every level, is accountable. the judge also made it clear that there has been no declared policy of the government not to grant minority status to the institutions, and as such, there was no illegality. he pointed out that to weed out and prevent the 'masqueraders', the paramount consideration for taking any such decision should be in the interests of the minorities and their education.
