HYDERABAD: A division bench of the high court on Saturday refused to interfere in the order of a single judge who had directed the Telangana State Public Service Commission to allow four debarred aspirants to appear for the Group-I prelims test on Sunday.
A bench of Justice Abhinand Kumar Shavili and Justice Namavarapu Rajeshwara Rao, which heard an appeal of TSPSC, reminded the commission that the single judge took enough precautions by asking the authorities not to publish the result of these four candidates till a clear picture emerges.
“But, they cannot be prevented from writing the exam as no judicial forum has found them guilty till now,” the bench said and closed the writ appeal filed by TSPSC. The commission had debarred the four candidates, suspecting their role in the question paper leak issue.
Justice P Madhavi Devi on Friday asked the authorities to issue them hall-tickets and allow them to write the exam. Stating that it would send wrong signals to lakhs of candidates, the TSPSC filed an urgent writ appeal.
The four candidates approached the high court and questioned the decision of the authorities. “No court has established our guilt and hence we cannot be prevented from appearing for exams,” counsel Mahesh Raje representing the aspirants argued.
Based on the findings from the probe, the officials had debarred the four aspirants from the selection process. Police suspect that they were part of the leak and say that they deserve to be debarred.
