HYDERABAD: A city court rejected a construction company's plea challenging the order of
Greater Hyderabad Municipal Corporation (GHMC) to stop further construction and remove all deviations at their 4.748 acre site in Nandagiri Hills in Shaikpet.
Chief judge K Kusha of City Small Causes Court, Hyderabad, passed the order on July 4, upholding the GHMC action against Net Net Ventures. The judge said, "the petitioner approached the court with unclean hands and there was no prima facie case made out to restrain the authorities." The firm, which had earlier approached the Telangana high court, was directed to appear before the GHMC for a personal hearing.
Subsequently, GHMC passed orders directing the firm to rectify all the deviations. Challenging this order, the firm moved the HC again, but withdrew the petition on their own. Later, they approached the city court to restrain the GHMC. While the matter was pending before the city court, GHMC issued a final order directing the firm to desist from further construction and remove all deviations as specified in their notice.
"This court is not able to appreciate what prompted the petitioner to deviate from the sanctioned plan, permit, apart from building by-laws and National Building Code," the judge said while rejecting the petition.
