HYDERABAD: The central administrative tribunal (CAT) on Monday directed the Andhra Pradesh and Telangana governments to file affidavits within three weeks to explain the rationale behind their decision to appoint J V Ramudu and Anurag Sharma as DGPs to their respective states.
The bench comprising judicial member B V Rao and administration member Minnie Mathew gave this direction, while hearing a plea by senior IPS officers S A Huda and T P Das, who challenged the appointment of incumbent DGPs of both the states.
The bench posed a question to AP's counsel Posani Venkateswarlu, as to how his regime has made a regular DGP appointment for AP, even before completion of final cadre allocation to the state.
"What you have with you now is the manpower allotted to you on a provisional basis. How can you make regular appointment based on such allotment"? the bench questioned.
The counsel replied that they followed the procedure laid down by the Supreme Court, duly involving the UPSC and considered all the seniors, before selecting Ramudu to the top post.
No prejudice is caused to Huda and Das on account of this and they will not gain anything even if the decision of the state is stayed, he said. Moreover, the final allocation of cadres has now separated even Huda and Das, the AP counsel said. While one was allotted to AP, the other was allotted to Telangana. The bench gave three weeks to both AP and Telangana to file their counters.
