Andhra Pradesh suspends IRS officer on deputation to state, CAT stays the state action
HYDERABAD: The Central Administrative Tribunal at Hyderabad on Monday stayed the action of Andhra Pradesh state that suspended IRS officer
The tribunal’s member (administration) B V Sudhakar issued this interim direction while hearing a petition filed by Krishna Kishore who challenged the action of the state in this regard.
Krishna Kishore came on deputation to AP and acted as the head of the state’s newly created economic development board in 2015 for four years. He was transferred out and attached to general administration department from May 2019 ever since the YSRCP regime came into power in AP. Charging him with misusing state’s money the state placed him under suspension and also directed the ACB and CID wings to investigate the funds embezzlement in the board. It issued an order GO RT No 2814 on Dec 12, 2019 to this effect.
Arguing the case of Krishna Kishore, his advocates Neeraj Malhotra and Parmatma Singh told the tribunal that Kishore is a commissioner rank officer in the income tax department and is due for promotion as principal commissioner of income tax department. He came here on an invitation from the state and rendered good service to the state on deputation. Since the current regime is not interested in his services, he has been requesting the state to repatriate him to his parent department, that is central board of direct taxes (CBDT). That was not done and on the other hand he is now placed under suspension and is on the verge of facing criminal prosecution, they said while terming the action of the state as unlawful and without jurisdiction. The state action was violative of Rule 10(1) of the Central Civil Services Rules, 1965, they said. The AP state counsel sought two days' time to inform the tribunal about the state version.
Krishna Kishore in his petition charged the YSRCP regime with being vindictive towards him. He also stated that he was the income tax authority who assessed the worth of Jagathi Publications during the CBI probe into YS Jaganmohan Reddy assets case. He contended that he did his job professionally and concluded that the share value of Jagathi was unduly enhanced. The tribunal posted the case to December 24 and till then it suspended the action of the state.
