of DLF
Park Place submitted that it is willing to withdraw the case concerning the launch of The Crest project from the Punjab and Haryana
high court if the Competition Appellate Tribunal (COMPAT
) hears the case. The apex court has allowed the RWA members to withdraw their writ petition in the high court.
Further proceedings in the high court shall remain stayed, directed the SC, "however, that will not prevent the RWA
from requesting the high court to withdraw the writ petition". The RWA will have to reply to the apex court on the matter on August 29. "We will appraise the SC whether COMPAT did proceed with the matter or not," said Amit Jain, director general, Federation of Apartment Owners' Association. The residents had made a submission in the Punjab and Haryana high court in May this year challenging the "ownership" of land on which DLF announced The Crest project. The HC had issued an ex-parte order restraining DLF from selling the project further. However, the SC vacated the ex-parte stay order of the high court. The builder had argued that it had already sold 250 flats at the launch of the project. The Crest is a high value project for DLF with apartments worth Rs 3.4 to Rs 6 crore and penthouses costing up to Rs 10.3 crore. DLF has welcomed the decision of the RWA.
