Seepage issue: HC orders Vagator co to deposit 7.5L for power restoration

Panaji: The high court of Bombay at Goa on Friday directed a company, Vianaar Facilities, to deposit Rs 7.5 lakh in the court in a week.

The company’s property manager approached the vacation judge for restoration of electricity supply to the residential complex La Zamora and La Risa in Vagator. Power was disconnected at the behest of a health official, as there was seepage there.

The company stated that it is taking steps to stop the leakage. The court said that after depositing the Rs 7.5 lakh, the health officer will instruct the electricity department to restore electricity.

The court also said that the company must ensure that the sewage treatment plant is commissioned within six weeks, to rectify the issue of seepage. On commissioning of the STP, a joint inspection will be carried out by the company and a health official in the presence of a PWD official, the court said.

“If the issue of seepage is not resolved on the commissioning of the STP, then the health officer would take the opinion of the PWD and inform the petitioner about further action necessary to rectify the seepage,” said Justice Jitendra S Jain.

He said that if the instructions are not complied with by the company within four weeks, the health officer will be at liberty to make an application to the high court for withdrawal of the necessary amount for rectification of the seepage, and then take measures to stop the seepage.

The court also said that if the amount spent by the health official to stop the seepage is less than the amount deposited in court, the balance would be refunded to the petitioner. If the amount is more, the petitioner will deposit the excess amount with the health official so that the work for seepage is not halted.
