HC: Consumer court order on Ola Electric CEO ‘perverse’

Panaji: The Bombay high court has quashed the bailable warrant and summons issued to Ola Electric Technologies CEO Bhavish Aggarwal, holding that the South Goa consumer disputes redressal commission had overreached its jurisdiction by ordering his personal presence.

The court held that the order was arbitrary and perverse, and could not be sustained on any legal ground.

The bailable warrant was issued in Jan after Aggarwal failed to appear before the commission despite prior notice. The commission had sought his presence to clarify the whereabouts of a customer’s scooter and explain the delay in repairing and returning it, after the company’s counsel was unable to provide answers during the hearing.
While setting aside the warrant and summons, the high court observed that there was no justification or reasoning in the commission’s Jan 20, 2026, order directing the personal presence of the company’s CEO and founder.

The high court further ruled that compelling the CEO’s appearance in the matter amounted to an excess of jurisdiction by the consumer commission.

The case arose from a complaint filed by a 26-year-old consumer who purchased an Ola S1 Pro 2nd Generation scooter on Aug 16, 2023, for Rs 1,47,499. He alleged that the scooter remains in the company’s custody and has not been repaired or returned.

The complainant has sought a refund of the full purchase amount along with Rs 50,000 as compensation for loss of value of money, harassment, mental pain and agony.
