Cabinet approves tweaked Clinical Establishment Bill
Panaji: The state cabinet approved the introduction of the Goa Clinical Establishments (Registration and Regulation) (Amendment) Bill, 2025, on Thursday. This bill is for clinical establishments that have not obtained provisional or permanent registration under the Act. These establishments are required to obtain permanent registration under the Act within a period of one year.
Govt will amend the Goa Clinical Establishments (Registration and Regulation) (Amendment) Act, 2019 (Goa Act 19 of 2019).
The bill seeks to insert a new section 20A in the Goa Clinical Establishments (Registration and Regulation) Act, 2019 (Goa Act 19 of 2019) (hereinafter referred to as the "principal act") to extend the time limit for provisional and permanent registration of the clinical establishments. The bill seeks to make a consequential amendment to section 45 of the said Act given the enactment of the Bharatiya Nyaya Sanita, 2023.
It seeks to amend section 47 of the said Act, as subsection 3 makes rule-framing a complicated procedure, which is not found in most of the statutes, resulting in delays. Even otherwise, the rule-framing procedure is prescribed in the General Clauses Act. As such, sub-section 3 is to be deleted.
The bill also seeks to repeal the Goa Clinical Establishments (Amendment) Ordinance, 2024, promulgated by Goa governor on Oct 10, 2024. In the bill, govt will insert a new section 20A facilitating an extension of the time limit for provisional registration.
“Notwithstanding anything contained in this Act or any other law, the clinical establishments that have not obtained provisional or permanent registration under this Act shall be entitled to apply and obtain permanent registration under this Act within one year from the date of it coming into force,” the cabinet said.
Also, the provisional registration granted under this Act in the past, which has lapsed shall stand revived or extended valid for one year from the date of coming into force of this section, said the cabinet.
