GHAZIABAD: A Pocso court in Ghaziabad on Friday convicted and sentenced a man to 20 years of rigorous imprisonment for the rape of a minor girl in Sahibabad in 2015. The accused, Ramsanehi, 40, and the victim lived in rented accommodation in the same building.
Harish Kumar, Special Public Prosecutor, said that the survivor lived with her family members on the ground floor while the accused lived on the first floor.
“On December 6, 2015, at 11 pm, the girl visited a common washroom on the first floor. The accused’s room was next to the toilet. He took her inside his room by pressing her mouth and raped her. The victim tried to scream, but Ramsanehi kept her mouth shut. When the victim did not come back after a long time, her father went to the toilet and found the accused raping his daughter in the next room,” he said.
At night, the family members filed a police complaint, and an FIR was registered the next day. The accused was arrested and sent to judicial custody. During the trial, the victim’s father told the court that he tried to catch the accused, but he pushed him and ran away. He then called the police.
The victim was first sent to a govt hospital in Ghaziabad and then referred to GTB Hospital in Delhi. Dr Madhubala, who performed the victim’s medical examination, said that there were blood stains on the victim’s private part and her hymen was torn and bleeding.
The victim told the court that she used to call Ramsanehi ‘uncle.’
“He gagged my mouth with his hands and took me to his room. There he removed my clothes and did a dirty act. I screamed, and hearing my cry, my father came for my rescue,” she said.
The accused’s lawyer produced a defence witness, Vikas Kumar, son of Ramsanehi, in the court. Kumar said that the minor girl lifted some items from his home and fled. “My father chased her as she was fleeing. In the process, she fell down 3-4 stairs and got injured.”
Deepika Kumari, Additional Special Judge, Pocso Act, relied on the prosecution witnesses and medical evidence and convicted the accused.
“He is sentenced to undergo rigorous imprisonment for 20 years and fined Rs 50,000 under Section 5 (m) of the Pocso Act,” the court said and added that in default of payment of the fine, simple imprisonment for one year will be served.
