Zohal Hamid, Luke Pomersbach move high court to quash FIR

A day after TOI reported that foreign national Zohal Hamid and cricketer Luke Pomersbach had reached an out-of-court settlement, the duo moved Delhi high court seeking to quash the FIR in the molestation case.

NEW DELHI: A day after TOI reported that foreign national Zohal Hamid and cricketer Luke Pomersbach had reached an out-of-court settlement, the duo moved Delhi high court seeking to quash the FIR in the molestation case. They termed the alleged incident of molestation in a post-match IPL party as “unfortunate”.
In a joint petition moved by Zohal, her boyfriend Sahil Peerzada and Australian cricketer Pomersbach, the trio has cited in the settlement that “no useful purpose” will be served in carrying on with the case.

Zohal and Peerzada stated that they have withdrawn all allegations against Pomersbach and have amicably settled their disputes.
On Thursday night, Hamid’s lawyer had confirmed that she had reached a settlement with Team Bangalore director Sidhartha Mallya and Pomersbach, TOI had reported. This followed a tweet by Sidhartha Mallya, saying, “The tweets/comments made were unfortunate, being the product of stressful circumstances…”. Though it was a late-night development, many copies of TOI had the report.
Team Bangalore player Pomersbach was arrested on May 18 after Zohal had alleged that she was molested by him in a five-star hotel. She had also alleged that Pomersbach had beaten her boyfriend Peerzada.
“All petitioners are young and have a long life ahead of them. They don’t want to blemish each other and wish to end this unfortunate episode,” the petition reads claiming the parties have reached a settlement amicably without any pressure or financial consideration. “Petitioners have reached a settlement as per settlement deed dated 23 May 2012..,” it added.
Zohal and Peerzada have agreed not to pursue the criminal case saying they are fully satisfied and believe in the genuineness and sincerity of regret expressed by Pomersbach. The trio has also agreed not to make any statement, written or verbal, which would defame or criticize the personal reputation of each other. It will be interesting to see what stand Delhi Police will adopt when the petition comes up for hearing in HC on Friday.
