NEW DELHI: A city court today granted the former youth congress leader and prime accused in the Tandoor murder case, Sushil Sharma, the option to exercise his right to get back possession of Baghiya Restaurant in Ashok Yatri Nivas here.
Additional sessions judge G P Thareja rejected an application filed by Hotel Queen Road Private Ltd seeking release of Ashok Yatri Nivas land.
The court said the application moved by Hotel Queen was technically defective as it was without the company’s seal and their counsel had no proper authorisation to represent the hotel. Holding that the matter was of a civil nature, the judge said the parties have to approach a civil court to settle any disputes.
The court on August 28 had, initially, asked Hotel Queen’s counsel Suruchi Aggarwal to give an undertaking saying the hotel would protect the rights of any person if claims regarding any property in that land arises and that it would obey all judicial orders regarding the same. But Aggarwal refused to give such an undertaking saying she would file written arguments on the matter following which the judge reserved his orders.
