Additional chief metropolitan magistrate Kanwaljeet Arora, convicting Sharma, compared the suicides of debt-ridden farmers to the poor recovery of government dues from tax defaulters.
The court said the offence committed by Sharma was of a serious nature as while on one hand the tax levied by the government would endeavour to bridge the divide between the haves and have-nots, people like Sharma had evaded paying tax.
The court convicted Sharma under the relevant provisions of the Income Tax Act under which he could be sentenced for three years with a fine.
According to the prosecution, former assistant commissioner of income tax office (ITO), H A Siddiquie, had filed the three complainants in the case. The prosecution stated that Sharma was given several occasions to deposit the dues.
The prosecution added that the ITO had issued three notices for the assessment year 1987-88, 1988-89 and 1989-90 for paying the tax amount of Rs 2.47 crore, Rs 21 lakh and Rs 25 lakh, respectively, but Sharma failed to pay up. The case in this regard was registered on May 1, 1996.

In the order the court also likened the conduct of Sharma to that of irresponsible millionaires who misuse rules to carry on business.
Sharma during the trial had claimed innocence by saying that the property and articles did not belong to him. The court on August 13, 2001 had framed charges against him.
