NEW DELHI: A Delhi court has ordered a perjury inquiry against a woman for making false allegations against BJP functionary Shahnawaz Hussain of raping her inside a farmhouse in April 2018.

The court stated that if complainants with ulterior motives are not discouraged, courts will be used to settle personal scores, undermining the mandate of the Hon'ble Supreme Court, which requires the filing of an affidavit with an application for FIR registration.

The court, in its Feb 20 order, was hearing Hussain's plea under Section 340 of the CrPC regarding false evidence and perjury. It noted, "the woman's claims went beyond rape allegations, including a forced consumption of cow meat, which appeared to have communal motives aimed at destroying Hussain's political career."

The court emphasised that the woman was legally bound by an oath while attesting her affidavit and had made false allegations. It found sufficient grounds to initiate perjury proceedings, calling it a gross case of deliberate falsehood to seek a beneficial court order.
