NE riots: Court frames charges in cop injury case
New Delhi: A city court has framed charges against two people in a case related to
Additional sessions judge Vinod Yadav framed charges for offences of rioting, unlawful assembly, attempt to murder and other relevant IPC sections against two people, both named Imran.
“…you both being from a particular community, along with your other associates (unidentified), formed an unlawful assembly, the object whereof was to obstruct the public servants in discharge of their duty, voluntarily causing grievous hurt by firing, assaulting them and use criminal force in prosecution of the common object of such assembly. You both, along with your other associates, committed offences punishable under IPC sections 143, 147 and 148 (rioting) read with section 149 (unlawful assembly) and within my cognisance,” the court said.
It added that the accused, both allegedly being part of an unlawful assembly along with their associates, caused grievous injuries on constable Deepak by firing gunshot with intention or knowledge that could have caused his death, both of them would have been guilty of murder, and thereby, allegedly committed an offence punishable under section 307 (attempt to murder) IPC read with section 149 (unlawful assembly) IPC.
Meanwhile, the court also framed charges against four others —Dinesh Yadav, Babu, Sandeep, Tinku — in a case of alleged vandalism and setting ablaze shops and houses in Gokalpuri on February 25.
It further framed charges against Sandeep Bhati for offence of attempt to murder and rioting, saying Bhati, allegedly being a member of an unlawful assembly, caused gunshot injuries to Shahrukh “merely on the account that he belonged to the other community.”
All the accused pleaded not guilty and claimed trial.
