Magisterial court told to look into hoarding display case against Kejriwal & others
New Delhi: A Delhi court on Tuesday directed a magisterial court to decide afresh on a complaint seeking an FIR against former chief minister Arvind Kejriwal and others for allegedly misusing public money by putting up large hoardings in Dwarka.Special judge Vishal Gogne said the order passed by a metropolitan magistrate, dismissing the complaint in Sept 2022, did not seek to find out whether a cognisable offence was committed."The matter is remanded back to the trial court to decide the application under Section 156(3) CrPC... with a speaking order on disclosure of a cognisable offence from the allegations made by the complainant," the court said. It was hearing a revision petition by Shiv Kumar Saxena, who moved the sessions court against the magisterial court's order, refusing to direct police to lodge an FIR.The complaint in 2019 alleged that Kejriwal, Matiala MLA Gulab Singh, Dwarka A ward councillor Nitika Sharma and others deliberately misused public money by putting up the hoardings.The court said the magistrate's order did not address allegations made by the complainant regarding the hoardings being an offence.TNN
