NEW DELHI: A city Motor Accidents Claims Tribunal (MACT) has awarded the family of a man killed in a road accident involving a speeding truck, an year ago, a compensation of around Rs 5 lakh.
The presiding officer of MACT, Dilbagh Singh said in a recent order: "The objective of providing compensation is to place the claimant as far as possible in the same financial position as before the accident." The court added, "Because the offending vehicle in the accident was insured, the insurance company, is thereby required to pay the compensation amount of Rs 4.68 lakh to the family of the deceased."
Victim Kailash Kumar's father Sohan Pal along with family members had filed the petition in the court on May 4, 2007 seeking a compensation of Rs 25 lakh.
The court ordered the insurance company to pay a total amount to the victim Kailash Kumar's father Sohan Pal, mother Shanti Devi and brother Nagesh Kumar.
On April 1, 2007, Kailash was riding pillion on the bike, driven by his friend, Amit Kumar. Both were returning from village Bhanpur in Bulandsahar to Delhi. After reaching Gautam Budh Nagar district, the truck, which was coming from the opposite side, hit the bike, grievously iinjuring Kailash, Pal said in the petition. Kailash later succumbed to his injuries, Pal added.
