NEW DELHI: The Delhi High Court on Monday upheld the order of Delhi Electricity Regulatory Commission (DERC) chairman to repatriate an employee adding that the decision was ‘‘lawful.’’
DERC director (administration) Aruna Bhatia had recently filed a writ petition alleging that chairman V K Sood had misused his position to gain personal favours.

She had also alleged that Sood had ‘‘malafide intentions’’ in repatriating her to her parent cadre, the Central Board of Direct Taxes.
Sood’s counsel Suresh Tripathi said the case was dismissed on grounds of merit. In his judgment the judge said, ‘‘Merely because the chairman has some grievance against the petitioner it would not mean that the order is malafide.’’ The writ petition has been dismissed.
