HC judge: IP framework must ‘re-invent’ itself in AI era

New Delhi: A Delhi High Court judge on Friday said intellectual property (IP) frameworks must "re-invent" themselves in light of the rapid growth of artificial intelligence.

Speaking at a summit on catalysing global investment for equitable and responsible AI in health, Justice Prathiba M Singh noted that existing IP systems were built to recognise human creativity and are now being tested by increasing machine-generated output.


Raising "unresolved questions", she asked whether countries would need to revisit WTO treaties or re-enact patent laws as AI becomes more central to innovation. She also sought clarity on inventorship and ownership in AI-generated content, questioning whether joint authorship or joint ownership models would be required and how much human intervention should be necessary for securing a patent.

On AI in health, Justice Singh said there was no uniform framework and called for stronger regulatory systems. TNN
