HC reserves order on seven BJP MLAs’ pleas against suspension
New Delhi: Delhi High Court on Tuesday reserved its judgment on the petitions filed by seven BJP MLAs, who had challenged their recent suspension from the remainder of the budget session of Delhi Assembly for allegedly interrupting lieutenant governor VK Saxena’s address. The single judge bench of Justice Subramonium Prasad reserved verdict on the pleas and asked the counsels appearing for the suspended MLAs and Delhi Assembly to file short written submissions, if any, within two days. The counsel for the suspended MLAs, senior advocate Jayant Mehta, submitted before the court that the suspension till conclusion of the proceedings before the privileges committee was in violation of the appropriate rules.Opposing the submissions, senior advocate Sudhir Nandrajog who appeared for Delhi Assembly said that the suspension of MLAs was a self-discipline mechanism. The suspended members are Mohan Singh Bisht, Ajay Mahawar, OP Sharma, Abhay Verma, Anil Vajpayi, Jitender Mahajan and Vijender Gupta.Earlier, when the court was informed that the MLAs wrote a letter of apology to the LG which was accepted by him and that they also sent the copy of the letter to the Speaker via email, the bench had asked the MLAs to meet the Speaker. However, since the matter was not resolved, the court heard the pleas on merits. On Feb 19, the matter was mentioned by the counsel representing the MLAs. The plea filed by the MLAs alleged that other members of the ruling party were also heckling and shouting inside the House. It stated that the Speaker had always shown a much lenient approach in dealing with the members of the ruling party when it came to maintaining the decorum of the House.
