NEW DELHI: A court reserved the order on the bail plea of Delhi Waqf Board chairman Amanatullah Khan on Tuesday. The order is likely to be pronounced around 3.30pm on Wednesday.

Special judge Vikas Dhull heard the arguments of the prosecution and the defence for over two hours before reserving the order. Atul Srivastava, additional public prosecutor who appeared for the anti-corruption branch (ACB) opposing the bail of the AAP MLA, alleged that Khan was not cooperating. "How can he not remember his CA? He told us that he had lost his phone while he was earlier seen handing it over," said Srivastava.

Opposing the submissions, Rahul Mehra, appearing for Khan, asked, "Where is the loss to the exchequer? You (ACB) got 10 days and didn't get any answer. Let's assume that they are right, but what's the criminality? All ingredients for Section 409 (criminal breach of trust by public servant or by banker, merchant or agent etc) of IPC are missing from the case."

Accusing that the prosecution has been treating Khan, arrested on September 16, like a terrorist, Mehra emphasised that his client had been a three-time MLA and there had been no violation of any rule, but just procedural lapses.

Meanwhile, the court granted a two-day custody of Kaushar Imam Siddqui aka Laddan to ACB, which had sought three days' remand. ACB had allegedly seized diaries, cash, arms and ammunition from his house and he has been accused of being a funds manager for Khan, who was sent to judicial custody for 14 days on Monday in the case of alleged financial and other irregularities at the waqf board.
