Cabbie driven by libido since school, police tell court

NEW DELHI: The city police on Friday told a trial court that the cab driver who allegedly raped a 27-year-old woman executive inside his car on December 5 was libidinous since school and all evidence indicate that he is the real culprit.
Arguing on framing of charges, police said all evidence proved beyond doubt that taxi driver Shiv Kumar Yadav raped the woman and also tried to commit unnatural sex with her.

The court has reserved its order on framing charges against Yadav for January 13.
"Scientific, medical and other evidence show that this (rape) was done by this man (Yadav)," special public prosecutor Atul Srivastava told additional sessions judge Kaveri Baweja.
The defence counsel, however, argued that offence of abduction was not made out against Yadav as the woman was not forced to sit in the cab and had boarded the taxi on her own.
Srivastava also submitted that the accused's DNA had been found on the woman and on her clothes and that, even on suspicion, the court can frame charges against Yadav.
Yadav's counsel, however, claimed that as per the woman's medical report no injury was found on her and claimed she had been tutored before recording her statement under section 164 of the Criminal Procedure Code (CrPC) before a magistrate. The defence argued the woman had told police Yadav had threatened to insert a rod in her if she resisted or raised an alarm, but the investigators have not recovered any iron rod as yet. To this, the judge said the woman had nowhere stated that Yadav had threatened her after showing her the rod.
Meanwhile, new facts emerged from Yadav's confession which was filed along with the chargesheet. "Main school ke samay se hi kamuk pravati ka tha (I was of libidinous nature from school)," 32-year-old Yadav had told police. The disclosure statement further reveals Yadav was involved in several cases of crime against women including a 2003 molestation case, a 2013 rape case in Mainpuri in Uttar Pradesh and another rape case in 2011 in which he has been acquitted.
